Human Rights & Public Law

In Malta, the protection of human rights and fundamental freedoms is entrenched in the Constitution as well as in the European Convention Act of 1987, which makes provision for the substantive Articles of the European Convention for the Protection of Human Rights and Fundamental Freedoms.

Human Rights law was one of the main topics lectured at the Academy for Criminal Justice by the Firm. Vincent Micallef and Associates offers its services in the field of Constitutional Law, mainly as a consequence to the Firm’s practice in the field of Criminal Law, including but not limited to defending the right to a fair hearing, the right not to be subjected to inhuman or degrading treatment, the prevention from arbitrary arrest and the right to a private and family life.

We assist and represent clients in Public Law matters such as in actions for judicial review of administrative acts – the process by which the Court ensures that the public bodies act fairly. The Firm also assists clients in this area of law by filing petitions to the Office of the President of the Republic of Malta and the Office of the Ombudsman in terms of the Maltese Constitution.   

Vincent Micallef is a Committee Member of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) in Strasbourg.
